Superdari in Pakistan
Superdari law is a regulation in Pakistan that stipulates that if a property (i.e., a vehicle) has been seized by the police due to criminal activity or it being ownerless, the owner of the property has to prove that the property was in their possession before being stolen to get it released from police custody.
This law is designed to protect the rights of the owners. If you have had your property stolen and it has been collected by the police, you will need to appear before the court to have the property released.
This law is based on the concept of “equitable estoppel,” which holds that a person who has benefited from another’s property should not be allowed to keep that property when it is rightfully the property of someone else.
The process of getting your property freed from police custody requires you to provide proof that you were the owner of the property before it was stolen. This may include documents such as a registration certificate or insurance policy.
The police will then investigate whether or not the property was stolen, and if so, they will release it to you. If they determine that the property was not stolen, then it will remain in their possession. Keep in mind that the court issues the property to the last possessor.
Examples of Complicated Scenarios
Things can be complicated in cases where, for example, a car is stolen, tampered with, and sold off to a new owner. In these cases, the burden of proof falls on the owner to show that they were the rightful owner of the car before it was stolen. If they are unable to do so, then the car may be released to the new owner.
This isn’t it. There have been many cases where a car gets stolen and is sold off to a new owner. When the first owner files an FIR and the police investigate, they find out that both owners had a tampered car. And let’s say that they are able to determine the actual number, but the owner is nowhere to be found. So, in this case, the court either decides not to release the vehicle to either of the owners or hand it over to the last possessor until the actual owner is found.
