How Long Does it Take to Get a Khula in Pakistan?

Obtaining a Khula in Pakistan involves both judicial and administrative steps. While the timeframe varies based on the court’s workload and the husband’s response, there is a standard legal path that most cases follow.

Estimated Timeframe for a Khula Decree

In general, a Khula case in the Family Court takes approximately 2 to 6 months. The duration depends heavily on the nature of the proceedings:

  • Uncontested Cases (2–3 Months): If the husband does not contest the suit or fails to appear in court after being served notice, the process is streamlined.
  • Contested Cases (6+ Months): If the husband contests the Khula, delays the proceedings, or misses multiple hearings, the case can extend beyond the six-month mark.

The Judicial Process in Family Court

The legal journey begins in the Family Court and follows these primary stages:

  1. Filing the Suit: The wife files a petition for Khula through her legal counsel.
  2. Court Notices: The court issues formal notices to the husband to ensure he is aware of the proceedings.
  3. Mandatory Reconciliation: Under Pakistani law, the judge must attempt pre-trial reconciliation between the spouses.
  4. The Decree: If reconciliation efforts fail and the wife remains firm in her decision, the court grants a Decree of Khula.

Post-Decree: Union Council and the 90-Day Period

Winning the case in court is the first major step, but the divorce is not legally “final” until it is registered administratively.

  • The Union Council: The court decree must be sent to the local Union Council.
  • The 90-Day Rule: By law, the Union Council issues a Divorce Certificate only after a mandatory 90-day waiting period.
  • Purpose: This period runs parallel to the Islamic concept of Iddah and provides a final window for potential settlement before the marriage is officially dissolved in state records.

When combining the court proceedings with the administrative waiting period at the Union Council, the total time to receive a final, legally recognized Divorce Certificate is usually between 3 to 7 months.
